The High Court has dismissed the writ filed on charges of dual citizenship and concealment of information, as a result, there is no longer any legal obstacle to the election of BNP nominated candidate Dr. MA Qayyum in Dhaka-11 constituency. The writ filed by 11-party alliance candidate Nahid Islam challenging the validity of Dr. Qayyum's candidacy has been dismissed outright, ending the uncertainty surrounding the election.
On Tuesday (February 2), a High Court bench comprising Justice Fahmida Quader and Justice Md. Asif Hasan passed the order. According to court sources, no acceptable legal basis was found to cancel the candidacy in the allegations raised in the writ.
Lawyer Mohammad Hossain Lipu and Advocate Zahirul Islam Musa heard on behalf of Nahid Islam in the court. On the other hand, Dr. Advocate Ahsanul Karim, Barrister Ruhul Quddus Kajal, Advocate Mahbubur Rahman Khan and Barrister Kazi Akter Hossain participated in the hearing on behalf of MA Qayyum.
Earlier, on Monday (February 2), Nahid Islam filed the writ in the High Court. In the writ, the candidacy of BNP nominated candidate Dr. MA Qayyum in Dhaka-11 constituency was sought to be suspended and the Chief Election Commissioner and the concerned parties were made respondents. The writ was filed by Advocate Zahirul Islam Musa and Advocate Ali Azgar Sharifi.
It is worth noting that the Election Commission had earlier declared the nomination papers of both Nahid Islam, the candidate of the 12-party alliance and convener of the National Citizens Party (NCP) in Dhaka-11 constituency, and BNP nominated candidate and the party's microfinance affairs secretary Dr. MA Qayyum valid. The High Court's latest order upheld that decision, paving the way for elections to be held in this constituency on time.
